WILLS & TRUSTS (ESTATE PLANNING)
Estate planning is for everyone, not just the wealthy or the aging. Anyone can become disabled at any time. One of the most important steps you can take to protect yourself and your loved ones is to establish an estate plan. A well-designed estate plan provide for loved ones, including minor children or aging parents, provide for incapacity, avoid probate at death, reduce or avoid estate taxes, and provide for charitable organizations. I meet with individuals and families to review their personal and financial situation, including their needs, concerns, hopes and goals, and explain the options available to them based on their situation. This may include wills, trusts, powers of attorney, advance medical directives, or a combination of these, depending on client needs and goals. Once their estate plan is in place, my client’s enjoy peace of mind knowing they have provided for themselves and their loved ones in case an unexpected crisis occurs.
I assist clients with all types issues that arise in the operation of a business. This includes selection and formation of business entities, purchase or merger of businesses, employment matters, contracts, collections, succession planning, collections and business litigation.
PROBATE (ESTATE ADMINISTRATION)
Administering the estate of a family member can be time-consuming and emotionally draining. Handling the details of an estate can be particularly hard if you are grieving the loss of a loved one or if there is disagreement within the family. I regularly represent clients who serve in a fiduciary capacity, such as executors, administrators, and guardians.
REAL ESTATE LAW
I represent real estate developers, banks, homeowner associations, and individuals as clients who I regularly assist with their real estate related legal needs. This includes but is not limited to preparing, amending and restating homeowner association documents, assisting with covenant enforcement matters, working with investors and individuals on unique or problem properties, and private party real estate acquisition and financing documentation. My oil & gas experience allows me to help resolve complex title problems for my clients.
OIL & GAS
Producers are leasing land all throughout Texas, in the Eagle Ford, Barnett, Permian and East Texas fields. Some leases in Texas are over 100 years old. A landman or oil and gas company may contact you about your mineral rights. You need to understand the documents that you are being asked to sign. Oil and gas documents are complex and unique to every parcel. Get the guidance you deserve before signing, you can bet that oil company has lawyers looking out for their interests, you should, too. Examples of what you may need to understand before signing are: how your surface and mineral rights will be affected, how your royalties will be calculated, what the length of the primary term of the lease is, how the term can be extended, what the pooling and unitization provisions of the lease are and how they work. You need to know if you should negotiate a separate right of way agreement and surface use agreement, whether you should warrant title and whether you should ask for audit rights or other protections.
